Courts to hold arbitration on civil suits before litigation

The judiciary courts across the country will be commencing the arbitration system on the civil law cases led by the courts on August 1, according to the announcement made by the Union Supreme Court on July 25.

The court-leading arbitration procedures will be exercised in all High Courts of respective state/region, Courts of Self-administered Divisions or Zones, District Courts, and Township Courts.

“There are plaintiffs and contestants in the civil law cases. When the plaintiff files a complaint with the court, the court accepts the lawsuit. However, the court informs the arbitration department about the case. The arbitration department summons both the plaintiff and contestant to discuss and settle the dispute. Both parties will be explained the legal procedures and rules. This system is resolving the dispute as per the legal provisions,” a source with a high level in judiciary pillar told NP News.

The court-leading arbitration system has been practiced as the trial period at the Dekhina District Court, Tatkon Township Court, Taungoo District, and Taungoo Township Court since March 2019 by the Union Supreme Court.

“Advantages will be cost-effective since there won’t be litigation. Civil suits usually take many years to be resolved in which appeals are submitted by the lower courts. If disputes are settled by the arbitration process, they don’t need to submit an appeal to the upper courts. Therefore, there will be less time-consuming,” the source continued.
